The judge rules the court room, listening to and for a precedent from tort law, while the jury hears testimony so they can decide if the defendant should be convicted. The judge also listens for the reason to decide from both the plaintiff and defendant, the ratio decidendi, on which he or she will pass sentence. If the defendant prevails, the judge pronounced him or her acquitted according to orbiter dicta.
