A problem caused by the Tenth Amendment is the potential for the abuse of states' rights. In some cases, states have used their power under the Tenth Amendment to resist federal laws or policies that they disagree with, such as desegregation in the 1950s and 1960s. This has led to accusations of states' rights being used as a cover for discriminatory practices, and has sometimes resulted in the federal government having to step in to protect the rights of minorities.
