You can solve this using liters, but it may be easier to follow/understand if you go through moles then back to liters.
Determine moles O2 used:
From PV = nRT, n = PV/RT
n = (3.98)(28.63)/(0.0821)(999.8) = 1.39 moles O2
moles CO2 = 1.39 mol O2 x 9 mol CO2/13 mol O2 = 0.961 mol CO2
Now, correct this for efficiency: 0.961 x 0.764 = 0.734 mol CO2
Liters CO2: PV = nRT and V = nRT/P
V = (0.734)(0.0821)(999.8)/3.98
V = 15.1 liters
