1) Government agencies have the ability to make rules and regulations because of the Administrative Procedures Act, or APA for short. The APA was passed in 1946. It has a framework for how agencies are legally allowed to pass rules, bring them under judicial review, and implement them.
2) Statutes that get passed tend to be broader than regulations. Regulations are able to fill in specific use case rules that agencies need to function. They also can be vetted more by the public than statutes, making it easier to repeal bad regulations over bad statutes.
