But had she just followed Democrat Party advice and resigned, she would have let Obama pack the court. So now Biden threatens to do an FDR court packing scheme.
The founding fathers, wanted checks & balances, to avoid tyranny, to avoid a King George. They wanted 3 separate co equal branches of government, at odds with each other. They succeeded. Although with Marshall and beyond, the Supremes have become Supreme in many respects.
Ginsburg just highlighted the occasional push & shove between branches angling for more power.
It's like the Christian Trinity. For Jews, there's the Father in charge. For Christians Jesus took over. For Pentecostals, the Holy Spirit reigns. Supposedly coequal, Catholic theology, but over the ages, one or the other gets to the top, like Greek's Zeus as Top Dog, among the Greek deities.
If a political party has the White House, they promote an "imperialist presidency" If they lack the White House, they complain about an "imperialist presidency." If they have the Supremes, they declare the Supreme Court rulings are the "Law" regardless of Congress or Presidential edicts.
It all depends on partisan politics, who you favor. You favor which branch or branches favor your politics. Without principles whatsover. It's all hyperbole, fake hype, deceptive rhetoric to advance the political agenda.
