The Framers made the Constitution so they could fix the problems caused by the Articles of Confederation. The Framers wanted to make sure the Constitution would make sure that the government’s power was not abusing the people’s rights. These problems included the states having more power than the federal government, Congress not being able to raise money or collect taxes since they did not have enough power, and their fear over the national government having too much power. To solve the first problem mentioned, the Constitution divided the power between the state governments and federal government. For instance, certain powers were given specifically to state governments (Reserved powers) or specifically to the federal government (Delegated powers), and the powers they both shared (Concurrent powers). The Constitution also established in the Supremacy Clause that the US Constitution is the highest or Supreme law of the land. The second problem was solved by giving Congress (Enumerated powers) which are powers explicitly listed in the Constitution such as the power of Congress to raise taxes. Congress also had the power to make laws “necessary and proper” to carry out their enumerated powers. The third problem was solved by creating a limited government, separation of powers, and checks and balances. Basically, the federal government is only allowed the powers they are given by the Constitution and cannot abuse it by doing things they are not authorized to do. Separation of powers gives the three branches of government different powers and duties so that one branch does not overpower the others. They have checks in place to limit the power of the other branches to make sure none of the branches has all the powers. Some of these checks include Congress’s veto power to override the president’s veto to proposed laws or the Supreme Court’s judicial review power to see if a law is constitutional or not.
