Generally, the court only takes cases with a real controversy. It doesn't like doing declaratory judgments.

So it took an act of civil disobedience, such as Rosa Parks refusing to move to the back of the bus to get the Supreme Court to consider the constitutionality of the Montgomery city ordinance requiring segregation on municipal buses
