Are orcs trademarked or copyrighted by Tolkien or anyone else?

I was using Orcs in a book when I was told by a friend that they were copyrighted. Is this true.

there are many forums on which you can read about the use of the word or idea of Orcs or Orcks before Tolkien used them.

Orcs or Orks predate tolkin by over 300 years in fact they are in Beowulf as Orcneaus ... They are public domain along with elves , dwarfs , goblins, dragons ....... The list goes on and on
