The purpose of Due Process is provide for fairness and the respect of individual rights in connection with the relationship of persons to the powers of government and the rights of other persons, specifically in the administration of justice. Its origin is in article 39 of Magna Carta. The principles are inscribed in the 5th and 14th Amendments to the US Constitution. The Supreme Court has since expanded the concept to “substantive due process” as a means to protect certain liberties deemed fundamental from government interference.
