Supreme Court Justices have assistants
on their staff who are lawyers themselves.
A Justice may want a particular 'Opinion'
to reflect the case law and previous decisions.
These 'Assistants' do the research specifically of
past case decisions and collect the best information available that reflects the Justice's opinion on Constitutional matters.
Previous case law and interpretation are comingled and interpreted based on Constitutional precedents.
Two Justice's can therefore point out differing or similar opinions on the very same topic but could have divirgent opinions based on previous case law when the political viewpoints are similar or differing.
