criminal law: the FBI raid on Trump's Florida home. Issues are validity of the search warrant, did it establish probable cause of a crime and that evidence of the crime was in the home. did the warrant specify with sufficient particularity the places to be searched and what was expected to be found. was the magistrate objective, impartial or should he have recused himself due to bias. Judge Reinhart donated to Obama. He's an anti-Trump Democrat, Capital D.
The federal prosecutors "judge shopped" to find the most friendly judge. Did they also fail to get other judges to sign the warrant after trying several who refused? should AG Garland have recused himself due to partisan bias, and appointed a special prosecutor like Ken Starr? Archibald Cox? He appears to blame Trump for not being appointed to the Supreme Court. Merrick's lifelong dreams dashed heartlessly.
Garland seems to have favored Hillary Clinton and Hunter Biden in not pursuing similar search warrants for having classified information on their computers and evidence of crimes on their computers. He also says he always looks first for the least intrusive method to obtain evidence, but he hasn't explained why he didn't have less intrusive alternatives in Trump's case or why they waited 1 1/2 years to get the warrant, and several days to execute the warrant after they got it, if they had an immediate concern for national security, or why they searched Melania's underwear and clothes. Garland also refused questions about the warrant. Is he redacting it when he released it? Garland defended associates of Jeffrey Epstein, effectivey defending sex slave traffickers. How reliable is his judgment? The FBI just previously signed false affidavits about the Steele dossier. Is their credibility suspect?
Trump claims he declassified the classified documents, as is within his authority as then President. similar to Hillary Clintons' defense of her possession of top secret documents. She claimed documents are routinely overclassified. Hillary though had no authority to declassify as Trump did. Yet Garland went after Trump but not Clinton. Latest pro-Trump legal argument is he had a standing order that any documents transferrd to his Florida home were ipso factor declassified. Then there's the story that it was DOJ who actually packaged the White House contents that were shipped to Florid from the White House. This case could be The legal dream, the Full Employment Act for lawyers who will complain about overwork for years (unless they retire first on endless billable hours making them rich before their time)
if Trump were charged with espionage and convicted, the appeal would likely go to the Supreme Court. Would it be a 5-4 decision reversing the conviction? Would any justices recuse themselves? would jury bias be an issue? Where would they find an unbiased jury not taintd by pretrial publicity? It's estimated 20% of jurors hide their bias to get on juries. Would everyone (on both sides, pro and anti-trump citizens) lie to get on the jury? If any conviction and prison sentence were affirmed, what prison would be his new home? supermax in Colorado where they house the Unabomber? is a death penalty possible for espionage? like the Rosenbergs? Would a judge sentence Trump to death? if Trump were about to have the lethal needle injected would Biden do a last minute reprieve and commute the sentence to life without parole? would Trump appeal a death sentence to the World Court in the Hague in Europe that abolished the death penalty. Would US death penalty opponents come to Trump's defence? Would Hollywood make movies out of this? What actors would play Trump, Garland and Biden? Will they make board games out of this? Like monopoly? Or cage matches, Mixed Martial Arts with boxers dressed up as Trump and Biden? Punching each other out. Pay per View raking in millions. Movies, board games, to the death boxing matches. Las Vegas going wild taking bets setting the sports odds. this is entertainment heaven. for entrepeneurs and businesses, casinos, worldwide.
Will any criminal conviction be overturned due to 4th Amendment violations? Illegal search and seizure of evidence without probable cause or lack of particularity in describing the evidence to be seized? Or improper execution of the warrant? Lawyers on both sides will work overtime on even more creative legal arguments, tying up the courts for decades until the parties die and the cases are moot.
human rights: war crimes in the Ukraine. Will Putin be charged? what tribunal would try him? The World Court in the Hague? Would any judgment be meaningless and never enforced? How would they gain personal jurisdiction? Personally serve him? How? IF he never appeared, would they appoint an attorney to represent him? Judge or jury trial? Where would they get jurors? A competent defense attorney or the most incompetent they could find? Would the court appoint an investigator for the defense? to make the trial look less one sided, a sham show of fairness? IF they sentenced Putin what would the sentence be? Death? or life in prison without the possibility of parole. IF they somehow captured Putin, arrested him, which prison would he be placed in? A Ukraine prison? European? German? US prison at max security in Florence Colorado, with the Unabomber? Would Russians try to help him escape? and start nuking US cities? Maybe put him in the US Cuban prison where we tortured Muslim terrorist suspects? Would we torture Putin too? Would Castro try to rescue Putin? overun the prison with the entire island's populattion?
youth cases: Will 17 year olds be tried as adults given the SCOTUS ruling making them 9 months older due to conception not birth as the date of their "personhood"? Will those convicted of statutory rape have their convictions overturned because their consenting "victim" is now or then retroactively over 18, after recalculating from conception? will the victim now testify in post conviction relief hearings that yes she was really a consenting adult, since Alito has explained it all so well.
bizarre: a McDonald's customer suing for causing his obesity by selling him cheeseburgers. IF he somehow won, what would damages be? Would any judge who ruled for the customer become laughing stock of the century among the public and legal community? Would a pro plaintiff ruling invite more lawsuits against Burger King, Whataburger, Killer Burgers, and more? Of course, if you can sue gun manufacturers for those killed by guns, why not sue burger manufacturers for obesity? sue anyone who says anything that leads to anyone being hurt? they used to have a legal concept "proximate cause," but it's being expanded to ignore foreseeable intervening events. what's bizarre is now "normal" are you an alcoholic? sue Coors, Budweiser, Wine orchards, Russian Vodka. Absolute, Absolutely. Maybe Bill Clinton, sex addict, will sue porn magazines, maybe sue women who dress not "modestly" Still a problem calculating damages. Bill would take money or personal services.
other: There once was a judge, Once upon a time (but his is not a fairytale, far from it) maybe in the Midwest somewhere, who got bored with his caseload, so in his spare time he began creatively writing fake cases and rulings. They got published. They showed major legal talent and legal reasoning. Lawyers began citing the rulings in their briefs and appeals. Then someone checked and discovered all the cases were fake. Well reasoned rulings though. Was the judge sanctioned? Were the lawyers who cited his rulings embarrassed, laughed at? OR did they just cover it all up to hide the embarrassment to all? deny it ever happened. All the published rulings got depublished and mysteriously disappeared without a trace. Like magic. Like the 3 monkeys with hands over their faces. see not, hear not, speak not. or was that the 3 stooges. 1 of the 2 or 3. (the movie "Three Stooges" is far better than the reviews say, worth watching more than once: someday the Trump era will spawn similar movies, for years to come. up there with Inherit the Wind on the Scopes Trial. As will the mysterious invisible creative writing judge doing fake rulings--- has to be a good plot for a comedy TV series. Especially after fake 'victims" in the fake rulings sue for defamation, seeking millions. An expected long running dramatic soap opera. Actor/Actresses are good at playing fake roles. Fake playing a fake person tops it all.)
