One day while reading the newspaper, Fred sees an advertisement:

“Exceptional offer: BMW Z4 Roadster for sale £12,000.”

The ad had been placed by a local car owner desiring to sell his used sports car.

Fred has always dreamt of owning a sports car and excited by the unique offer he sends an

email on 10th of January as follows: 

“I would like to purchase the BMW Z4 Roadster. Can you tell me whether or not the car has a

leather interior?”

On the 11th of January, the seller responds:

“Dear Fred, I am afraid that the car only has polyester seats. Are you still interested?”

On the 15th of January, Fred replies confirming his interest in the car. However, he is told that

the car has now been sold to somebody else.

Advise Fred on the following:

a) Was the seller contractually bound to sell the car to Fred?

b) If he was bound, what remedies are available to Fred?

A valid contract involve contractual agreement between two parties

To qualify for a breach of contract both parties must have entered into an express or implied agreement with consideration. In this case, both parties have no contract. Promisee did not accept promisor initial offer.
