The Sunnyside is an oil tanker which was registered in Lupine. The Sunnyside was arrested by Geraniums patrol on 28 October 2007, at about 195 nautical miles from the baseline of Geraniums baseline. According to the international law, the State have the jurisdiction up to 200 nautical miles, from the baseline.
Situation of the arrest:
At the time of it arrest, Sunnyside was engaged in selling gas oil as bunker to fishing and other vessels off the coast of West Arugula. The Sunnyside left Daikon, Carrot, on 24 October 2007 fully laden with 5,400 metric tons of gas oil. On 27 October 2007, between 4.00 am and 02.00 pm the Sunnyside supplied gas oil to three fishing vessels, the Primo, the Kale and the Eleni, at 22 nautical miles from Geraniums’ island of Alcatraz. All three fishing vessels were licensed by Geraniums to fish in its exclusive economic zone. Upon instructions from its owner, Sunnyside sailed towards another location beyond the southern border of the exclusive economic zone of Geraniums and it had been drifting since 04.20 am while awaiting the arrival of fishing vessels to which it has to supply gas oil. And at about 09.00 am the Sunnyside was attacked by a Geraniums patrol boat. The patrol officers of Geraniums subsequently boarded the ship and arrested it. It was asserted by the Geraniums that the action against the Sunnyside was taken not because the ship was navigating in the exclusive economic zone of Guinea but because it was engaged in “unwarranted commercial activities”.
Lupine claim that the arrest of Sunnyside was illegal and want to claim damages from Geraniums.
