Hi, That's what separates Natural minor scale from Harmonic minor scale. In the key of E minor, if the 5th chord of the scale is B minor (B D F#) this is a E natural minor scale. If the 5th degree is B (B D# F#) or B dominant 7th (B D# F# A) this is more likely Harmonic minor or it could be melodic minor.
