If Steve is suing only for damages, this would be an action in law. Be careful though because in a patent infringement case Steve may want an injunction to prevent Peter from continuing his alleged infringement. This would be an equitable action. Be sure to reas your prompt carefully.

Steve wants to sue Peter because Peter violated a patent Steve owns. However, Steve doesn’t know whether his lawsuit will be an action in equity or not? If Steve is only suing for $100,000, what is the correct thing to tell Steve?
