I think that anyone that commits an infraction or an offense should face consequences. Consequences are a natural part of the learning process of life and serve as deterrents to future crimes. If the consequences are proportional to the offense then they may not deter further acts. How minor or severe those consequences are is generally something that is established by state or federal legislation or local ordinances. The fines or penalties vary by jurisdiction but they are more or less very similar. In New Mexico,
Petty misdemeanor penalties may include, but are not limited to:
Up to 6 months in jail
$500 fine
6 month probation
Community service
License suspension

Full misdemeanor offenses (assault and battery) penalties may include:

For Felonies it varies:
• First degree felony resulting in the death of a child, life imprisonment;

• Second degree felony for a sexual offense against a child, fifteen years imprisonment;
• Second degree felony, nine years imprisonment;
• Third degree felony resulting in the death of a human being, six years imprisonment;
• Third degree felony for a sexual offense against a child, six years imprisonment;
• Third degree felony, three years imprisonment; or
• Fourth degree felony, eighteen months imprisonment.

New Mexico does not have the death penalty. I think that is more a question of religious beliefs.
